2033 generic entry — Royalty-free generic license begins January 1, 2033
Ultragenyx’s DOJOLVI patent settlement resolves one generic challenge, preserving U.S. exclusivity until 2033 while leaving other lawsuits pending.
Ultragenyx is a commercial rare-disease biotech with four approved products; DOJOLVI generated $96 million of 2025 revenue against $673 million companywide, making it meaningful but not the main growth engine. The settlement removes one immediate litigation overhang but does not change near-term commercial access. Navinta receives a non-exclusive, royalty-free license to launch a DOJOLVI generic on January 1, 2033, potentially delayed to July 1, 2033 if pediatric exclusivity is granted. 〔0〕 That is a long runway for the branded product, but the company has conceded a defined future entry point rather than continuing to seek a complete block.
The information is partly known, not a fresh strategic surprise. Ultragenyx disclosed an essentially identical settlement with another DOJOLVI ANDA filer, Esjay, on August 7, 2026, also setting generic entry for January 1, 2033. The new filing therefore mainly adds another settled challenger and confirms the emerging litigation pattern; it does not establish that all generic threats are resolved. 〔1〕
The remaining tension is future competition, not current execution. The filing gives no payment, royalty, revenue, or earnings impact, and the agreement still must be submitted to the FTC and DOJ. 〔2〕 That makes this a modestly mixed business event: it reduces legal uncertainty while formally establishing another route to generic competition beginning in 2033.
Bottom line: This is a contained DOJOLVI legal settlement, not a near-term business reset. It preserves several years of branded-market runway but confirms that generic entry remains the eventual outcome for another filer, with other cases still unresolved.
